1. Acceptance
Accessing, browsing, registering, using or publishing within the platform constitutes express acknowledgment that you have read, understood and accepted in all their terms these Terms, the Comprehensive Privacy Notice and any policy, annex or particular condition that Ubica Casa publishes. If you act on behalf of a legal entity, you declare that you have sufficient authority to bind it.
If you do not agree with any provision of these Terms, you must refrain from using the platform. Continued use after a modification is deemed tacit acceptance of the current version.
2. Definitions
- Platform: the ubica.casa website, mobile applications, dashboards, APIs and services operated by Ubica Casa.
- User: any natural or legal person who accesses or uses the Platform.
- Professional: a real estate agent, agency, developer, broker, notary, appraiser, insurer or any person offering real estate or complementary services through the Platform.
- Owner: a natural or legal person with rights over a property who publishes listings on the Platform as a direct owner.
- Content: texts, photographs, videos, floor plans, descriptions, comments, data, files and any information published on the Platform.
- Premium services: paid plans, featured listings, advertising credits, professional verification, bulk upload and other functionalities subject to a fee.
- Account: the personal space enabled by Ubica Casa after the User or Professional registers.
3. Nature of the service
Ubica Casa is a technology platform for informational intermediation. Its purpose is to facilitate the meeting between people interested in real estate transactions (purchase, sale, rental, transfer, development, financing) and professionals or owners who offer properties or services. Ubica Casa does not own the published properties, is not a party to the transactions concluded between Users, and does not act as an agent, advisor, intermediary, trustee, real estate broker, financial institution, bank, SOFOM, insurer, lawyer, accountant, notary or any regulated intermediation figure.It neither guarantees nor undertakes the closing of any transaction.
The published information comes mainly from Users and Professionals. Ubica Casa makes reasonable moderation and verification efforts, but does not guarantee the truthfulness, accuracy, currency, integrity, availability or legality of information published by third parties. The final decision on any real estate transaction, hiring of a professional service or use of content is the exclusive responsibility of the User.
4. Registration and account
To access certain features it is necessary to register an Account by providing true, complete and up-to-date information. The User is responsible for the truthfulness of the data and for keeping it current. Only natural persons over 18 with legal capacity or legally constituted legal entities may register.
The User is responsible for the confidentiality of their access credentials. Any activity carried out with their credentials will be deemed to have been done by them. They must immediately notify [email protected] of any unauthorized access, misuse or suspected breach.
Ubica Casa reserves the right to reject, suspend or cancel registrations it considers inappropriate, duplicate, fraudulent, automated or non-compliant with these Terms, without any liability.
5. User obligations
The User undertakes, without limitation, to:
- Use the Platform in good faith and in accordance with the law, public order and good customs.
- Not impersonate others, present false data or deceptively operate multiple accounts.
- Not use the Platform for fraudulent, unlawful purposes or purposes contrary to these Terms.
- Not publish content that infringes the rights of third parties, or is offensive, discriminatory, defamatory, slanderous, obscene, violent or that incites violence.
- Not publish false, inaccurate, misleading or outdated content, or content that promotes pyramid schemes, illegal multi-level marketing, money laundering or terrorism financing.
- Not use automated mechanisms (bots, scrapers, spiders) without express written authorization.
- Not reverse engineer, decompile or attempt to derive the Platform's source code.
- Not introduce viruses, malicious code, denial-of-service attacks or damage the technical infrastructure.
- Respect the privacy and intellectual property of third parties.
- Independently verify information before making real estate or financial decisions.
6. Professional obligations
In addition to the above, the Professional undertakes to:
- Provide and keep current the legal, tax and, where applicable, professional registration documentation required for their activity.
- Publish only properties or services for which they have express authorization from the owners or sufficient rights.
- Keep listings up to date and remove those that are no longer available.
- Not publish duplicate properties or inflate inventory with nonexistent properties.
- Respond to prospect inquiries with diligence and honesty.
- Comply with the applicable provisions of the Civil Code, the Federal Tax Code, the law for the prevention of operations with illicit funds and other regulations applicable to their professional activity.
- Pay the fees for the contracted plans on time.
- Not use abusive or deceptive solicitation practices.
7. Published content
The User and the Professional are solely responsible for the Content they publish. They declare and warrant that the Content is their property or that they are licensed to use and publish it, that it does not infringe third-party rights and that it is lawful. Ubica Casa does not endorse or assume responsibility for Content published by third parties.
By the mere act of publishing Content on the Platform, the User grants Ubica Casa a worldwide, non-exclusive, royalty-free, sublicensable, transferable license, for the entire duration of the Content, to use, host, store, reproduce, modify, distribute, publicly communicate, translate, index, classify and display such Content on the Platform, on social media, in search engines, in promotional materials and in any other digital or physical medium related to the operation or dissemination of Ubica Casa, for the sole purpose of fulfilling the object of the service.
8. Moderation and suspension
Ubica Casa reserves the right, at any time and at its sole discretion, to:
- Review, edit, hide, unpublish or delete Content it considers to be in violation of these Terms, the law, third-party rights or internal policies.
- Suspend or cancel Accounts that violate these Terms, without prior notice.
- Limit the reach, visibility or number of listings of an Account.
- Share information with authorities when there is a legal requirement or a security risk.
- Deny access, registration or use of services to any person, without the need to state a cause.
Suspension or cancellation does not generate any liability for Ubica Casa towards the affected User or third parties. Fees previously paid for plans or premium services are not refundable when the suspension or cancellation results from a breach by the User or Professional.
9. Plans, payments and billing
Ubica Casa offers premium plans and services with rates published in the pricing section or expressly quoted to the Professional. Prices may be modified at any time; modifications apply from the next billing cycle. Payments may be processed through authorized third parties.
The Professional authorizes the recurring periodic charge to the registered payment method for the entire duration of the contracted plan, unless previously cancelled in accordance with these Terms. The issuance of a digital tax receipt (CFDI) requires providing complete tax data before the close of the billing period.
Late payment immediately suspends access to premium features. Reactivation of the service may be subject to surcharges, late-payment interest and the submission of additional information. Prolonged non-compliance may lead to cancellation of the Account and reporting to a commercial credit bureau, without prejudice to any applicable out-of-court or judicial collection.
10. Cancellation and refunds
The User or Professional may cancel their plan at any time from their dashboard or by writing to [email protected]. Cancellation takes effect at the end of the current billing cycle. Partial periods are not refundable unless an express legal provision applies.
Services contracted as featured listings, advertising credits or one-time services are not refundable once activated. Ubica Casa may offer a refund, discount or credit at its sole discretion in the event of major technical failures that prevent use of the service for more than 48 continuous hours, subject to verification.
11. Intellectual property
The "Ubica Casa" brand, logo, isotype, visual identity, screen design, interfaces, source code, databases, original editorial content, translations, professional photographs produced by Ubica Casa, illustrations, iconography, derivative products and any original work generated or licensed by Ubica Casa are the exclusive property of Ubica Casa or its licensors and are protected by the applicable laws on copyright, industrial property and unfair competition.
No element of these Terms transfers intellectual property rights to the User. Using the brand, editorial content or code without express written authorization is prohibited. Copying, reproducing, distributing, publicly communicating, transforming or any form of exploitation without authorization constitutes infringement and entitles Ubica Casa to pursue all corresponding legal actions.
12. User content license
Content provided by the User remains the User's property. However, the User grants Ubica Casa the license described in clause 7 above. The license survives while the Content remains published and for the historical records, backup copies and promotional materials into which it may have been incorporated, in accordance with the law.
13. Third-party services and links
The Platform may include links, integrations or references to third-party services (notaries, banks, insurers, brokers, appraisers, carriers, payment platforms, social media, maps, analytics tools). Ubica Casa does not control, supervise or guarantee the quality, truthfulness, availability, legality or security of those services. The contractual relationship arising from contracting a third-party service is understood to be entered into directly between the User and the third party. Ubica Casa is not a party and assumes no liability for performance, quality, damages or disputes.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the User expressly acknowledges and accepts that:
- The Platform is offered "AS IS" and "AS AVAILABLE", without express or implied warranties of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, continuous availability or error-free operation.
- Ubica Casa does not guarantee the truthfulness, accuracy, currency, quality, legality or usefulnessof information published by third parties on the Platform, including prices, descriptions, photographs, locations, features, documents, floor plans, availability, the legal or tax status of properties, or the identity of owners or representatives.
- Ubica Casa is not responsible for transactions concluded between Users, or for payments, deposits, deliveries, damages, breaches, disputes, hidden defects, eviction, liens or any other circumstance arising from real estate transactions or professional services.
- Ubica Casa is not responsible for investment, purchase, sale, rental or financing decisionsnor for the economic, tax, accounting, financial or personal consequences arising from them. The information in simulators, calculators, guides, blog and editorial content is for reference and does not constitute professional advice.
- Ubica Casa is not responsible for service interruptions, maintenance, technical failures, cyberattacks, breaches, loss or corruption of data, viruses, or for damage caused by accessing or using Content published by third parties.
- Under no circumstances shall Ubica Casa, its shareholders, officers, directors, employees, representatives, providers, contractors, allies or affiliates be liable for indirect, special, incidental, consequential or punitive damages, lost profits, moral damage, reputational harm, loss of opportunity, loss of data or any other analogous damage, even if they had been advised of the possibility of such damages.
- Ubica Casa's maximum aggregate liability towards a User, for any cause and under any legal theory (contractual, non-contractual, strict, for moral damage or any other), shall not exceed the amount actually paid by that User to Ubica Casa in the six months immediately preceding the event giving rise to the claim, or, if there was no payment, an amount equivalent to MXN $5,000.00 (five thousand pesos 00/100 national currency). This limit is essential to entering into this agreement.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In those cases, Ubica Casa's liability shall be limited to the greatest extent permitted by applicable law.
15. Indemnification
The User undertakes to defend, indemnify and hold harmless Ubica Casa, its shareholders, officers, employees, representatives, providers and affiliates, from any claim, demand, proceeding, sanction, fine, expense, damage, loss, cost, attorneys' fees (including reasonable fees and court costs) arising from or related to: (i) the User's breach of these Terms, the Privacy Notice or any applicable law; (ii) Content published by the User; (iii) the User's transactions or relationships with third parties through the Platform; (iv) infringement of third-party rights (including intellectual property, privacy and image rights); (v) false or misleading information provided by the User; (vi) misuse of the Platform.
Ubica Casa reserves the right to assume the exclusive defense and control of any matter subject to indemnification by the User, in which case the User will reasonably cooperate with Ubica Casa.
16. Force majeure and acts of God
Ubica Casa shall not be liable for the non-performance or partial performance of its obligations when this is due to an act of God or force majeure, understood as, by way of example, armed conflicts, acts of terrorism, pandemics, health emergencies, catastrophic natural phenomena, general telecommunications failures, massive cyberattacks, authority decisions, regulations that prevent operation and any other cause beyond Ubica Casa's reasonable control.
17. Modifications
Ubica Casa reserves the right to modify these Terms at any time. Modifications will be published on this page with the update date in the header. Continued use of the Platform after the publication of modifications constitutes acceptance. If the modifications are substantive, they will be notified to the User's registered email.
18. Term and termination
These Terms have an indefinite term as long as the User maintains access to the Platform. Ubica Casa may terminate the relationship at any time with or without cause. The User may request the closure of their Account by writing to [email protected].
The clauses relating to intellectual property, the Content license, limitation of liability, indemnification, governing law and jurisdiction, as well as any other provision that by its nature must survive, will survive termination.
19. Governing law and jurisdiction
These Terms are governed by the federal laws applicable in the United Mexican States. For the interpretation, execution and fulfillment of these Terms, the parties expressly submit to the jurisdiction of the competent federal courts in the United Mexican States, waiving any other jurisdiction that may correspond to them by reason of their present or future domicile or for any other cause.
Before initiating any legal action, the parties will seek to resolve their differences through good-faith discussions over a period of no less than 30 calendar days from the written notification of the dispute to the email [email protected].
20. Final provisions
Severability. If any provision of these Terms is declared null, invalid or unenforceable by a competent authority, that provision shall be deemed not written without affecting the validity and enforceability of the rest.
Entire agreement. These Terms, together with the Privacy Notice and the other referenced documents, constitute the entire agreement between the User and Ubica Casa, superseding any prior communication, proposal or agreement.
Assignment. The User may not assign the rights and obligations arising from these Terms without the prior written consent of Ubica Casa. Ubica Casa may freely assign its own to any company in its group, successor or acquirer.
Notices. Notices to Ubica Casa shall be sent to the email [email protected]. Notices to the User shall be deemed validly made to the email registered in their Account.
Waiver. Any omission, delay or tolerance by Ubica Casa in requiring compliance with any provision shall not constitute a waiver of the right to require it later.
Languages. The official language of these Terms is Spanish. Any translation is for reference and, in case of discrepancy, the Spanish version prevails.
Headings. Clause headings are included solely to facilitate reading and do not affect their interpretation.
Express acceptance
By using the Platform, registering an Account, purchasing a plan or publishing Content, the User declares having read, understood and accepted these Terms in their entirety, without reservation, and undertakes to comply with them.
